The following provisions establish the general conditions of sale for the products offered on the website  www.skinup-eboutique.com. Buyers will be provided with these T&Cs before ordering and must accept them without reservations before orders can be confirmed.

1 — Company

2 — Subject

These general terms and conditions of sale (hereinafter referred to as the "T&Cs") apply, without restriction or reservation, to all remote sales concluded between SKIN UP and its customers, deemed exclusively to be natural persons who are not traders and who are not acting in a professional capacity (hereinafter referred to as the "Buyer"), relating to the following products: slimming, sculpting, firming and anti-cellulite clothing (hereinafter referred to as the "Products") offered for sale by Skin’Up on the Website  www.skinup-eboutique.com These general terms and conditions of sale (hereinafter referred to as the "T&Cs") apply, without restriction or reservation, to all remote sales concluded between SKIN UP and its customers, deemed exclusively to be natural persons who are not traders and who are not acting in a professional capacity (hereinafter referred to as the "Buyer"), relating to the following products: slimming, sculpting, firming and anti-cellulite clothing (hereinafter referred to as the "Products") offered for sale by Skin’Up on the Website

Skin'Up and the Buyer are hereinafter referred to individually as the "Party" and jointly as the "Parties". ».

The T&Cs particularly specify the conditions for placing orders, making payments, and the delivery and return of the Products ordered by the Buyers.

All Products offered for sale online by Skin’Up, as well as their main characteristics, and in particular the specifications, illustrations and details of the Products, are presented on the Website in technical data sheets, in accordance with Articles L. 111-1 and L. 111-4 of the Consumer Code.

Skin'Up may not be held responsible for photographs of the Products presented on the Website. The Buyer must refer to the descriptions of the essential characteristics of each Product.

The T&Cs apply to the exclusion of all other terms and conditions. They must be accepted by all Buyers prior to ordering and will prevail, if applicable, over all other versions and any other contradictory documents.

Acceptance of these T&Cs requires that Buyers have the necessary legal capacity to do so. The Buyer declares that he/she is legally capable of concluding this contract, the terms and conditions of which are presented below, i.e. that he/she is of legal age and is not under guardianship or trusteeship.

The Buyer declares that he/she has read and accepted the General Terms and Conditions before placing the order. As these T&Cs may be modified at a later date, the version applicable to the Buyer's purchase is the one in force on the Website on the date the Buyer placed the order.

Confirmation of the order therefore implies acceptance of these T&Cs without restriction or reservation.

The Buyer acknowledges the evidential value of Skin'Up's automatic registration systems and, unless proof is provided to the contrary, waives his/her rights to contest them in the event of a dispute.

3 — Contractual documents

The T&Cs, the order confirmation email and the invoice constitute the entirety of the contractual documents existing between the Parties.

4 — Prior information

The Buyer acknowledges having received, prior to placing the order, in a clear and understandable manner, the General Terms and Conditions and all information and details referred to in Articles L.111-1 to L.111-7 of the Consumer Code, and in particular:

  • The essential characteristics of the Products;
  • The price of the Products and related costs (e.g. delivery costs);
  • The date on which, or the period within which, Skin'Up undertakes to deliver the Products;
  • Information relating to Skin'Up's identity, postal, telephone and electronic contact details, and business;
  • Information regarding legal guarantees and their activation;
  • The ability to use conventional mediation in the event of a dispute.

The fact that a Buyer orders a Product implies acceptance of the T&Cs, which is expressly acknowledged by the Buyer, who waives, in particular, the right to rely on any independent document that is not binding for Skin'Up.

The T&Cs are available on request from Skin'Up's customer care service by email, post or telephone, at the address indicated at the top of the T&Cs, and may be viewed on the website at any time.

In order to be able to access the Website and place an order, the Buyer have access to an Internet connection. Telecommunications costs required to access the Website are the sole responsibility of the Buyer.

5 — Orders

Buyers who wish to register and/or order on the Website, must be at least 18 years old and be legally capable of entering into a contract.

The Buyer undertakes to comply with these pre-conditions.

To proceed with an order, the Buyer, after having connected to the Website, must select the Products he wishes to purchase on the Website by clicking on the "Add to cart” button.

The Buyer may, at any time:

  • View a summary of the Products he has selected by clicking on "Show cart" on the right hand side of the screen;
  • Continue to select Products by clicking in the menu or search area;
  • Change the quantities ordered in the summary of selected Products by clicking on the "Show Cart" icon and then indicating the desired quantities in the input field;
  • Delete individual Products by clicking on the "Show Cart" icon, then selecting the Products to be remove and clicking on the button to the right of the cart;
  • Complete the selection of Products and order these Products by selecting the chosen delivery and payment methods, and then clicking on the "Payment" button.
  • Creating an account

To confirm the order, the Buyer must identify him/herself by creating an account on the Website.The creation of an account requires the following information:surname, first name, postal address and a valid email address, a phone number.

In addition to this, the Buyer must choose a username and password during the account creation stage, these must be kept for subsequent identification on the Website.

The password must include a minimum of 6 characters (which can be letters, numbers and special characters), it must be kept secret and not revealed to others.

The username and password are strictly personal and confidential. Skin'Up cannot be held liable in the event of fraudulent use of a Buyer's account by an unauthorized third party.

The Buyer may request to unsubscribe at any time by going to the dedicated page or by sending an email to contact@laboratoire-skinup.com. This will be done within a reasonable time, it being specified however that the Buyer's information is required for processing orders.

In the event of non-compliance with the T&Cs, Skin'Up may suspend or even close a Buyer's account after formal notice sent by electronic means goes unanswered.

The deletion of an account, for whatsoever reason, will result in the deletion of all the Buyer's personal information.

  • Order confirmation

The order is considered to be irrevocable after payment confirmation (by clicking on the “Confirm" button during a card payment, for example).

Following confirmation of the payment and therefore of the order, a confirmation message is sent to the Buyer by email, at the email address provided when creating the account.

This message includes a summary of the Product(s) ordered and the total price, the delivery address indicated by the Buyer and the delivery and payment terms. This document is for information purposes only and does not constitute proof of payment.

The Buyer undertakes to check their spam and junk mail inboxes to make sure this message has been received and Skin'Up is not responsible in the event that the Buyer does not open the email.

If the confirmation message is not received, the Buyer is asked to check that the order has been correctly placed and payment made, and to contact Skin'Up at the address indicated at the top of the T&Cs (by email, telephone or post) to check that the order has been properly processed.

  • Product unavailability

Product offers are subject to availability of stock. In the event of total or partial unavailability of one or more Products after placing the order, the Buyer will be informed by email of the delivery of a partial order and the unavailability of one or more Products, or cancellation of the order if all Products are unavailable.

Skin'Up will then refund the amounts paid for the unavailable Products, as well as the delivery costs paid in the event that the entire order is unavailable, within 14 days of confirmation of the order (which occurs at the time the Buyer receives the order confirmation email).

Skin'Up will refund the amount on the payment method used to place the order.

  • Sales documents

Purchase orders and invoices will be archived in digital format and made available on the Website.

6 — Price

The prices displayed on the Website are in Euros, excluding postage and packaging.

Skin'Up reserves the right to change its prices at any time.

The price applicable to Buyers wishing to buy a Product is the one displayed on the Website at the time of confirmation of payment and acceptance of said payment by the Buyer's bank.

6.1. Taxes

For orders delivered in mainland France, prices are inclusive of all taxes. They include VAT applicable in France on the day of the order. Changes in VAT will be immediately apply to all orders placed after entry into force of the change.

For orders delivered in countries other than mainland France, the Buyer is the importer of the product or products concerned. Consequently, the prices are exclusive of tax. Customs duties and other local taxes or import duties may be payable.

These duties and taxes are the sole responsibility of the Buyer and shall be his sole responsibility both in terms of declarations and payments to be made to the competent authorities and/or bodies.

6.2. Preparation, packaging and transport costs

Preparation, packaging and transport costs are calculated according to the number of Products ordered and the destination country, and are the responsibility of the Buyer. These costs are indicated to the Buyer when orders are being confirmed.

7 — Payment

7.1 Payment methods

The Products are paid for using the method chosen by the buyer when confirming the order:

When paying by credit card, the Buyer must enter the card number, the expiry date and the security code on the back of the card.

When paying by credit card or private card, the card will be debited as soon as the payment is confirmed by the Buyer. The commitment to pay given using a payment card is irrevocable.

By providing his or her credit card information, the Buyer authorizes Skin'Up to charge his/her credit card for the amount corresponding to the all-inclusive price.

The Website employs a system for securing online payments with the adoption of SSL (Secure Socket Layer) encryption in order to protect sensitive data related to payment methods as effectively as possible.

The Buyer warrants that he/she is fully entitled to use the payment method used to pay for the order and that the payment method is able to access sufficient funds to cover all costs arising from the purchase of Products on the Website.

No data relating to the Buyer's payment method is collected by the Website. Payment is made directly to the bank or payment service provider receiving payment from the Buyer.

7.2. Payment default

In the event that the total amount of the order, including delivery costs, cannot be debited, the online sale will immediately be lawfully cancelled and the order cancelled as well.

Skin'Up reserves the right to refuse to deliver Products to a Buyer who has not fully or partially settled a previous order, or with whom a payment dispute is underway.

8 — Delivery

8.1. Delivery methods

The selected Products will be accompanied by all descriptive documentation on delivery.

Transport and delivery of the Products are done by Skin’Up’s carrier at the time the order is confirmed: All transport methods with parcel tracking.

  • In mainland France, it will be by COLISSIMO or ANY OTHER MEANS WITH PARCEL TRACKING.
  • Outside of mainland France, it will be COLISSIMO OUTRE MER or COLISSIMO INTERNATIONAL or ANY OTHER MEANS WITH PARCEL TRACKING.

The order will be delivered to the delivery address specified by the Buyer using the online order form, provided that it falls within the authorized delivery areas. The Buyer must ensure that the packages are able to reach the recipient without difficulty when delivered, by including all information necessary for proper delivery of the packages on the online order form. To this end, the Buyer undertakes to provide a valid, correct and complete address. The Buyer is responsible for the delivery information indicated in his account and confirmed at the time of the order.

In the event of an error and/or incomplete information in the delivery address indicated by the Buyer, Skin'Up may not be held liable for consequences such as delays or cancelled deliveries. All costs related to the reshipment of Products due to an incorrect or incomplete address will be the sole responsibility of the Buyer.

In the event that the recipient of the order is absent on delivery, the carrier will leave a delivery note instructing the recipient to go to the place where the package is stored (at the nearest post office in France). The recipient of the order has a period of 15 days following the first delivery attempt to collect the package, according to the terms indicated on the delivery notice.

After this period, the Product(s) will automatically be returned to Skin'Up. Skin'Up may contact the Buyer again to set out the conditions for possible reshipment. The cost of processing the new delivery, a flat-rate amount of ten (10) Euros, will then be invoiced to the Buyer.

Skin'Up may not be held liable in the event that COLISSIMO, the Post Office or any OTHER MEANS OF TRANSPORT fail to deliver the Products correctly.

8.2. Delivery times

In mainland France, delivery times start on the date that Skin’Up dispatches the order, i.e. up to 48 hours after placing an order for orders confirmed during working hours before 12pm, and up to 72 hours after placing an order for orders placed outside of working hours or after 12pm, and subject to the availability of the Products indicated on the Website.

Delivery times are shown in working days.

In the event that delivery by a carrier requires an appointment with the Buyer, the latter will contact the Buyer to arrange a delivery appointment as soon as possible.

If orders for several Products placed at the same time have different delivery times, the latest delivery time will apply to the order. However, Skin'Up reserves the right to divide shipments. Processing and shipping costs will only be charged for one shipment.

The Buyer is reminded that when he/she (or a third party designated by him/her) physically takes possession of the Products ordered, the risk of loss or damage to the Products is transferred to the Buyer.

8.3. Delivery errors and delays

If the delivery time cannot be respected by Skin'Up, the Buyer will be informed as soon as possible and may either accept an additional time limit or cancel the order and request a refund.

In the event that the Buyer cancels the order, Skin'Up undertakes to reimburse the Buyer for the sums paid within 14 days following the Buyer's request for a refund at the latest.

If, before receipt of the request to cancel the order, Skin'Up has fulfilled its obligations, the order will not be cancelled and the Buyer may use the right of withdrawal to return the Products.

The Buyer may immediately terminate the order contract if Skin'Up fails to fulfil its obligation to deliver the Product within the specified time limit, and said time limit constitutes an essential condition of the order contract for the Buyer. This essential condition results from the circumstances surrounding the conclusion of the order contract or from an express request by the Buyer before its conclusion, by registered letter with acknowledgement of receipt or by email to the address indicated at the top of the T&Cs. When the order contract is terminated, the Buyer shall be reimbursed for any amounts debited within 14 days of receipt of the Buyer's notice of cancellation.

The refund will be made to the same payment method as the one used by the Buyer to pay for the order.

If the Buyer's package is returned to Skin'Up by the Post Office or other postal service providers, Skin'Up will contact the Buyer on receipt of the returned package to ask him/her how his/her order is to be handled.

If the Buyer has mistakenly refused the package, he/she may request it be returned by paying the delivery costs for the new shipment in advance. Postage must be paid even for orders for which the shipping costs were free at the time of the order.

Skin'Up may not be held liable for late deliveries due exclusively to the unavailability of the Buyer after several appointments have been offered by the carrier.

8.4. Shipping costs

Delivery costs are indicated on the Website at the time of placing the order, regardless of the place of delivery and the quantity and volume of the Products ordered.

No additional costs will be charged to the Buyer once the order has been paid for, with the exception of those related to re-delivery under the conditions stipulated in articles 8.1. to 8.3.

However, the Buyer will only pay the price indicated at the time of placing the order, including for deliveries outside of mainland France.

These costs are subject to change.

By default, the delivery method will be shipment via a carrier chosen by Skin'Up.

8.5. Checking the order

On receipt of the Products, the recipient must check the general appearance of the packaging of the Product delivered, as well as its contents.

It is the Buyer's responsibility to make all reservations and complaints deemed necessary regarding non-conformities and apparent defects in the delivered Products (e.g. parcels damaged, already opened, missing or damaged during transport, etc.) with all relevant supporting documents (photos in particular), or to refuse parcels when they are obviously damaged on delivery, and to immediately inform Skin'Up. Such reservations and complaints must be indicated by the Buyer on the delivery note, in the form of accurate and detailed handwritten reservations, accompanied by the Buyer's signature, and must also be addressed to the carrier by extrajudicial document or registered letter with acknowledgement of receipt, within three working days, excluding public holidays, of the date of delivery of the Products. The Buyer must also send a copy of this letter to Skin'Up. Failure to file a claim within the aforementioned period shall remove the right to recourse against the carrier in accordance with Article L.133-3 of the French Commercial Code. Skin'Up may also refuse to accept Product returns.

Skin'Up may not be held liable for the loss or damage of packages once the delivery note has been signed without reservations.

9 — Right of withdrawal and return

In accordance with articles L121-18 et seq. of the Consumer Code, the Buyer has a withdrawal period of fourteen (14) clear days from receipt of the order to inform Skin'Up of his/her willingness to use his right of withdrawal without having to justify the decision or pay penalties.If this period expires on a Saturday, Sunday or a public holiday or non-working day, it is extended until the next working day.

In accordance with applicable legislation, the right of withdrawal may not be exercised for personalised Products (article L221-28 3 of the Consumer Code), for Products likely to deteriorate or expire quickly (4), for Products which have been unsealed by the customer after delivery and for those which cannot be returned for reasons of hygiene or health protection (5)..

The Buyer then has a further period of 14 days after exercising the right of withdrawal to return the Products to Skin'Up.

The Product(s) must be returned in perfect condition for resale in suitable packaging, and accompanied by all documents delivered with the Product (packaging, boxes, sheaths, advice booklets, cardboard boxes, etc.) to the following address:Laboratoire Skin’Up, Chemin de la Noraie, 37190 AZAY LE RIDEAU, France.

The Buyer may only be held liable in the event of deterioration of the Products resulting from handling, other than that necessary to establish the nature, characteristics and proper functioning of said Products.

The costs of returning order are entirely at the expense of the Buyer.

Following exercising of the right of withdrawal by the Buyer, Skin'Up will refund all sums paid by the Buyer, i.e. the price of the returned Product(s) as well as delivery costs, within 14 days from the date on which Skin'Up receives all Products in their original condition.

When the order is only partially returned, the shipping costs are not refunded by Skin'Up.

When the Buyer has chosen a special delivery method that is more expensive than the standard delivery method, only the costs of the standard method will be refunded.

The refund will be made to the same method of payment as that used by the Buyer when placing the order.

The costs and risks associated with the return of the Product(s) are the responsibility of the Buyer.

Skin'Up therefore encourages the Buyer to take out insurance with his carrier against breakage / theft / loss, sufficient to cover the market value of the returned Products, and to send the returned Products by registered post.

At the end of the fourteen (14) day period after delivery of the Products, they will be deemed to be in conformity with the order and to have been accepted by the Buyer. No refund will then be possible under the right of withdrawal.

10 — Exchange

Only Products returned in accordance with Article 10 of the T&Cs can be exchanged.

All requests for exchanges are subject to acceptance by Skin'Up's customer care service.

To request an exchange, the Buyer, after making the withdrawal request, must state the Products he/she wishes to receive in exchange, their reference numbers and include a cheque for shipping costs in the amount of six Euros. The re-shipment period is thirty days at most.

In order to be processed by Skin'Up, the exchange procedure must include the following steps:

  • The Buyer must contact Skin'Up customer services to obtain a return number and approve the exchange;
  • The Buyer must comply with the return conditions set out in Article 10 of the T&Cs;
  • The Buyer must include the return number as well as a letter showing his/her exact contact details, the order number and the Products desired in exchange;
  • The package must be sent to the following address: Laboratoire Skin’Up, Chemin de la Noraie, 37190 AZAY LE RIDEAU, France.

All conditions related to the return of Products in Article 10 of the T&Cs apply in the event of a request for an exchange.

11 — Legal guarantees

The Products comply with the applicable regulations in France and are compatible with non-professional uses.

The Buyer benefits:

  • From the legal guarantee of conformity provided for in articles L217-4 et seq. of the Consumer Code, for Products that are apparently defective, deteriorated or damaged, or do not match the order, enabling the Buyer to obtain, within two years of delivery of the Product, and at no cost, the repair or replacement of the Product if it does not conform to the order;
  • The legal guarantee against hidden defects resulting from materials, design and manufacturing defects affecting the Products and rendering them unfit for use within the meaning of articles 1641 et seq. of the Civil Code, under which the Buyer may request, within two years of the discovery of the defect, the total or partial refund of a Product which has proved unfit for its use.

In order to assert his/her rights, the Buyer must inform Skin'Up, in writing, of non-conformity of the Products within a maximum period of two years from the provision or delivery of the Products, or of the existence of hidden defects within a maximum period of two years from their discovery.

Skin'Up may not be held liable in the following cases:

  • Non-compliance with the legislation of the country in which the Products are delivered, which it is the Buyer's responsibility to check.
  • Misuse, professional use, negligence or lack of maintenance on the part of the Buyer, such as normal wear and tear of the Product, accidents and force majeure.

Skin'Up's warranty is, in any event, limited to replacement (within the limit of available stocks) or refund for Products that do not conform or are defective.

Skin'Up will do its best to ensure that the photographic representations of Products on the Website is as faithful as possible to the Products. However, given that the Products are presented on the Internet, and the specific and non-standardized shape of each Product, it is possible that the Buyer's perception of the photographic representation of the Products will not exactly match the Product itself.

Refunds may be paid using any method.

In any event, these provisions do not prejudice the Buyer’s right of withdrawal, as set out in the T&Cs.

Skin'Up reminds the Buyer of the following provisions of the Consumer Code and the Civil Code:

  • Article L217-4 of the Consumer Code

« The seller shall deliver the goods in conformity with the contract and is liable for all non-conformities existing at the time of delivery.

It shall also be liable for defects in conformity resulting from packaging, assembly instructions and installation, when the contract makes him responsible for these, or when they have been carried out under his responsibility.  »

« The goods are in accordance with the contract:

1° When they are fit for the use usually expected of similar items and, if applicable: when they match the description given by the seller and have the qualities that the seller has presented to the buyer in the form of a sample or model; if they have the qualities that a buyer can legitimately expect in view of the public statements made by the seller, the producer or their representatives, in particular in advertising or labelling;

2° Or when they have the characteristics defined by mutual agreement between the parties or are suitable for any special use required by the buyer, brought to the attention of the seller and which the latter has accepted.»

« Non-conformities which become apparent within 24 months of delivery of the goods shall be presumed to have existed at the time of delivery, unless proven otherwise.

For second-hand goods, this period is set at six months. Theseller may oppose this presumption if it is not compatible with the nature of the goods or the alleged lack of conformity. »

« The seller is bound by the guarantee against hidden defects in the item sold that make it unfit for the use for which it is intended, or that reduce this use to the extent that the buyer would not have purchased it, or would have only paid a lower price if he had been aware of them. »

12 — Additional guarantees and promotional offers

Skin'Up may grant additional guarantees which do not replace the legal guarantees.

Similarly, Skin'Up may offer promotional offers on its Products. These offers are always within the limits of the stocks available for the promotional offer, and are limited by the promotional period and the conditions defined by Skin'Up. Promotional offers only concern the Products designated by Skin'Up on its Website.

13— Responsabilities

Skin'Up draws the Buyer's attention to the importance of respecting the contraindications indicated on the Website in the product descriptions.

In particular, the Cosmetic Textile Products sold on the Website are not recommended for use by pregnant or breastfeeding women or persons allergic to any of the product’s components.

The list of allergens that may be present in Products is available by request from the Skin’Up Customer Care service.

Due to the diversity of uses and conditions of use of the Products sold on the Website, the Buyer must ensure that he/she respects the uses for which they are intended, and this under their own responsibility.

Skin'Up, persons related to Skin'Up and/or the Website may not be held liable in the event of non-compliance with these contraindications by the Buyer or user of the Products, nor in the event injuries that may occur due to allergies to any of the components of the Product in question.

Lastly, Skin'Up cannot be held liable in the following cases:

  • Failure to achieve the slimming goals advertised on the Website or those expected by the Buyer or user of the Products. The results advertised on the Website are only indicative and are not guaranteed by Skin'Up. They depend on compliance with the conditions, regularity and duration of use of the Products;
  • Inconveniences or damage inherent in the use of the Internet, in particular service interruptions, external intrusions or the presence of computer viruses;
  • Failure or delay in the performance of one of the obligations described in the T&Cs attributable to the Buyer or resulting from a case of force majeure, meaning any external, unforeseeable and unstoppable event within the meaning of Article 1218 of the Civil Code.

14 — Intellectual property

The entirety of this Website is protected by intellectual property law.

All text, comments, trademarks, illustrations and images reproduced on the Website are protected by copyright, trademark law and image rights.

They are the exclusive property of Skin'Up.

Only use for private purposes subject to different or more restrictive provisions of the Intellectual Property Code is authorized, in accordance with Article L122-5 of the Intellectual Property Code. Total or partial reproduction of the Website is strictly prohibited.

Skin'Up reserves the right to modify, delete, suspend or interrupt access to all or part of the Website at any time, for any reason and at its sole discretion, including and in particular for the content and products presented and marketed therein.

15 — Personal data

Skin'Up cares about personal data protection and is committed to ensuring the highest level of protection for the Buyer's personal data in accordance with Data Protection Act No. 78-87 of 6 January 1978 relating to data processing, files and freedoms, as well as Act No. 2004-801 of 6 August 2004 amending it, relating to the protection of individuals with regard to the processing of personal data, and Commission Regulation No. 2016/679.

Different types of data are collected during the Buyer's visit to the Website.

15.1. Personal information

Information (surname, first name, address, email, phone number...) is collected when the Buyer registers using the forms on the Website. This is necessary to ensure the transaction takes place correctly and to enable Skin'Up to improve the Products and services it offers and the information it sends to Buyers.

These data are confidential.

The Buyer has the right to access, rectify, delete, update, limit and oppose, for legitimate reasons, personal data concerning him or her. Buyers need only write to Skin'Up at the address indicated at the top of the T&Cs, stating their full name and email address. In accordance with current regulations, the request must be signed and accompanied by a photocopy of an identity document bearing their signature and specifying the address to which the reply should be sent. A reply will then be sent within one month of receipt of the request.

Buyers may also consult or modify their personal data in their accounts directly on the Website.

If you have problems managing your personal data, you can file a complaint with the CNIL.

15.2. Messages and emails

Buyers may receive messages from Skin'Up by e-mail, telephone or post.

These messages may include: information on Products and services, advice, news about new products, promotional offers, loyalty offers, etc.

If they does not wish to receive this information, there are two ways to unsubscribe:

  • Click on the unsubscribe link at the bottom of each email;
  • Or, if one is not present, send a request to Skin'Up using the online contact form or by post to the contact details at the top of the T&Cs.

Buyers may also consult or modify their personal data in their Internet accounts.

15.3. C ookies

The Website uses cookies. The purpose of a cookie is to track the Buyer's visit to the Website.

A "cookie" is a text file that records information related to the Buyer's browsing terminal (computer, tablet, smartphone...). Only the issuer of the cookie may read or modify the information contained therein. It cannot contain viruses.

Buyers can read, delete or disable these cookies at any time in their browser settings.

Skin'Up's cookies

Skin'Up uses cookies on the Website to simplify navigation and to provide more relevant information. Cookies are used to identify the Buyer and to access accounts, to save the cart and continue the order, to store the browsing history and to personalize the offers that Skin'Up sends out.

They can also be used to adapt the presentation of the Website to the display preferences of the Skin'Up terminal (type of terminal, country, etc.).

Statistical cookies

During the Buyer's visit, Skin'Up also generates cookies enabling it to establish statistics and volumes for visits and use of the various elements comprising the Website (sections and content visited, itinerary). This data enables Skin'Up to improve the usefulness and ergonomics of its services and to send Buyers personalised offers on the Website and by e-mail, if the Buyer is a subscriber.

These cookies only store an "identifier" and are, under no circumstances, used to collect personal information about the Buyer.

The data collected are not passed on to third parties.

Third-party cookies

When Buyers access the Website, one or more cookies from partner companies may be placed on their computers.The purpose of these cookies is to identify the Buyer's interests according to the Products viewed or purchased on the Website and to collect browsing data in order to personalise the advertising content sent to him/her outside the Website.

Skin'Up uses social network applications.

Social networks providing an application button (such as Facebook, Twitter, Instagram et Youtube) are likely to identify Buyers through this button, even if the Buyer did not use it when visiting the Website.Indeed, this type of button may allow the social network in question to track Buyers’ browsing on the Website, solely because his or her account on the social network in question was activated on their terminal (open session) while browsing the Website.

Skin'Up has no control over the process used by social networks to collect information relating to the Buyer's browsing habits on the Website nor the personal data at their disposal.

Skin'Up invites Buyers to read the privacy policies of these social networks to learn about the uses made, including advertising, of the browsing information they may collect through these application buttons.These protection policies must in particular enable Buyer to exercise choices, in particular through setting up their user accounts for each of these networks.

16 —Partial non-validation

If one or more provisions of these T&Cs are found to be invalid or declared invalid pursuant to a law or regulation or following the final ruling of a competent court, the other provisions shall retain their full force and scope.

17 — Applicable law and competent jurisdiction

The T&Cs are subject to French law. The language of the T&Cs is French.

Buyers are informed that, in the event of a dispute or litigation, they may always resort to conventional mediation procedures, in particular with the Consumer Mediation Commission (Article L. 612-1 et seq. of the Consumer Code), or with existing sectoral mediation bodies, or with through alternative dispute resolution method (conciliation, for example).

In the event of a cross-border dispute, Buyers may refer the matter to the European Consumer Centre: europe-consommateurs.eu.

Buyers are in no way obliged to take legal action in the first instance, this is merely an option.
